These Terms of Service govern your access to and use of the official website, online membership registration system, member database system, online forms, digital services, and any related online platform operated by PROGRESSIVE DEMOCRATIC PARTY (“the Party”, “we”, “our” or “us”).

By accessing this website, creating an account, submitting a membership application, updating your membership details, or using any online service provided through this website, you agree to be bound by these Terms of Service, the Party’s Personal Data Protection Notice, Privacy Policy, and all applicable rules, constitution, by-laws, regulations, policies and procedures of the Party.

If you do not agree with these Terms, you should not use this website or submit any information through the website.

1. Acceptance of Terms

By using this website, you confirm that you have read, understood and agreed to these Terms of Service.
These Terms apply to all visitors, users, applicants, members, administrators and authorized personnel who access or use the website or any related digital platform of the Party.
The Party may update, amend or replace these Terms from time to time. Continued use of the website after such changes are published shall constitute acceptance of the updated Terms.

2. Eligibility for Membership Registration

The online membership registration system is intended only for individuals who are eligible to apply for membership in accordance with the Party’s constitution, by-laws, rules and applicable laws of Malaysia.

To apply for membership through this website, you must:

a. be a Malaysian citizen;
b. provide accurate, complete and truthful personal information;
c. meet all membership eligibility requirements under the Party’s constitution and by-laws;
d. not submit an application on behalf of another person without proper authority;
e. not create duplicate, false, misleading or fraudulent registrations; and
f. comply with all membership rules, disciplinary rules and internal procedures of the Party.

For the avoidance of doubt, residency in Malaysia alone is not sufficient for membership registration. An applicant must be a Malaysian citizen unless otherwise expressly permitted by the Party’s constitution and applicable law.

The Party reserves the right to request supporting documents, including proof of identity, citizenship, address, branch/division information, or any other information reasonably required for verification purposes.

3. Account Registration and Accuracy of Information

Where the website allows users or applicants to create an account, you are responsible for ensuring that all information submitted is true, accurate, current and complete.

This may include, where applicable:

a. full name as per NRIC;
b. NRIC number;
c. date of birth;
d. gender;
e. citizenship status;
f. contact number;
g. email address;
h. residential address;
i. branch, division, constituency or locality information;
j. membership category; and
k. any other information required for membership administration.

You agree to promptly update your information if there are any changes.

The Party shall not be responsible for any loss, delay, rejection, communication failure or administrative issue arising from inaccurate, outdated, incomplete or false information provided by you.

The Party may suspend, reject, cancel or remove any account or application if the information provided is found to be false, misleading, incomplete, unverifiable or inconsistent with the Party’s rules.

4. Membership Application Subject to Approval

Submission of an online membership application does not automatically confer membership status.
All applications are subject to verification, review and approval by the Party in accordance with its constitution, by-laws, internal procedures and applicable Malaysian laws.
The Party reserves the right to approve, reject, defer, suspend, cancel or require further verification of any membership application at its discretion and in accordance with the Party’s rules.
A person shall only be recognized as a member upon completion of the relevant approval process and confirmation by the Party through its authorized officers, system records or official communication channels.
Nothing on this website shall be construed as creating an automatic right to membership, office, voting rights, delegate status, candidacy, appointment, nomination or participation in any internal process of the Party.

5. Electronic Records and Communications

By using this website or submitting any online form, you agree that the Party may use electronic records, electronic forms, system-generated acknowledgements, email, SMS, WhatsApp, phone calls, website notices or other digital communication methods for administrative and membership-related purposes.

Such communications may include:

a. account verification;
b. membership application status;
c. requests for further information;
d. event notices;
e. official announcements;
f. branch or division-related communications;
g. membership updates;
h. internal notices; and
i. other administrative communications.

You agree that electronic submissions, acknowledgements and records may be retained by the Party as part of its official administrative and membership records.

You are responsible for ensuring that your contact details remain accurate and accessible.

6. Personal Data and Privacy

The Party collects, processes, stores, uses and discloses personal data in accordance with its Personal Data Protection Notice, Privacy Policy and applicable Malaysian personal data protection laws.

By submitting your personal data through this website, you acknowledge that your data may be processed for purposes including:

a. membership registration and verification;
b. identity and citizenship verification;
c. branch, division or constituency allocation;
d. maintenance of the Party’s membership database;
e. internal administration and record keeping;
f. official Party communications;
g. event registration and coordination;
h. eligibility verification for meetings, voting, delegate appointment or internal processes;
i. disciplinary, compliance or constitutional matters;
j. security monitoring and fraud prevention;
k. compliance with legal, regulatory or reporting obligations; and
l. any other purpose reasonably connected with Party membership and administration.

Where required, the Party may share your personal data with authorized officers, branch or division administrators, internal committees, service providers, professional advisers, regulators, government authorities or any other party, where permitted or required by law.

The Party will take reasonable steps to protect personal data under its control. However, you acknowledge that no online system, database or electronic transmission can be guaranteed to be completely secure.

7. Sensitive Personal Data and Political Affiliation

By applying for membership in a political party, you acknowledge that the information submitted may indicate or relate to your political affiliation, political participation, political opinion or membership status.
You expressly consent to the collection, processing, storage, use and disclosure of such personal data, including sensitive personal data where applicable, for membership registration, verification, administration, internal organization, communication, compliance and related Party purposes.
The Party shall process such data in accordance with its Personal Data Protection Notice, internal data protection policies and applicable Malaysian laws.

8. Use of the Membership Database

The membership database is the property and official administrative record of the Party.

Access to the membership database is restricted to authorized users only. Members, applicants, officers, administrators or any other person shall not access, use, copy, download, export, disclose, transfer, publish, sell, distribute or misuse any membership data except with proper authority from the Party.

The membership database may be used for:

a. verifying membership status;
b. processing new applications;
c. updating member records;
d. branch and division administration;
e. event registration and attendance verification;
f. internal communication;
g. delegate or voting eligibility verification, where applicable;
h. disciplinary and compliance matters;
i. audit and reporting purposes; and
j. other official Party purposes.

Unauthorized access, disclosure, extraction, copying, alteration, deletion or misuse of membership data is strictly prohibited and may result in suspension of access, disciplinary action, termination of membership, civil action, criminal complaint or reporting to relevant authorities.

9. Account Security

You are responsible for maintaining the confidentiality of your username, password, one-time password, verification code or any other login credentials used to access the website.

You must not:

a. share your login credentials with another person;
b. allow another person to use your account;
c. use another person’s account without authorization;
d. attempt to bypass security controls;
e. access data that you are not authorized to access; or
f. interfere with the operation of the website or database system.

You must notify the Party immediately if you suspect that your account has been compromised or used without authorization.

The Party reserves the right to suspend, disable, reset or restrict access to any account for security, administrative or compliance reasons.

10. Acceptable Use of Website

You must not:

a. submit false, misleading or fraudulent information;
b. impersonate another person;

11. User-Submitted Content

Where the website allows you to submit forms, documents, photographs, messages, comments, files or other content, you are responsible for the accuracy, legality and appropriateness of such content.

You warrant that:

a. the content is true and accurate to the best of your knowledge;
b. you have the right to submit the content;
c. the content does not infringe the rights of any third party;

e. the content does not contain viruses or harmful code.

12. Fees, Payments and Donations

Payment of any fee or donation does not automatically confer membership status, voting rights, delegate status, office, appointment, nomination or any other Party entitlement unless expressly confirmed by the Party in accordance with its constitution and rules.
All payments must be made through authorized payment channels. The Party shall not be responsible for payments made to unauthorized persons or accounts.
Refunds, if any, shall be handled in accordance with the Party’s applicable policies and the specific terms stated for the relevant payment.

The Party may suspend, restrict, disable, terminate or delete any account, application, access right or user-submitted content if:

d. there is a security risk;
e. the user misuses membership data;
f. the user breaches the Party’s constitution, by-laws, rules or policies;
g. the user acts in a manner prejudicial to the interests, reputation or security of the Party;
h. required by law, regulation, court order or authority; or
i. the Party considers such action necessary for administrative, security or compliance reasons.

Suspension or termination of website access does not necessarily determine membership status unless decided in accordance with the Party’s constitution, by-laws and disciplinary procedures.

16. Intellectual Property

All intellectual property rights in this website and its contents belong to or are licensed to the Party.

This includes, without limitation:

a. the Party’s name, logo, emblem, symbol and branding;
b. website design and layout;
c. text, photographs, graphics, documents and videos;

17. Limitation of Liability

18. Indemnity

Where personal data is no longer required, the Party may securely archive, anonymize, delete or destroy such data in accordance with its internal policies and applicable law.

20. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia.
Any dispute arising from or relating to these Terms, the website, membership registration, online services or use of the membership database shall be subject to the jurisdiction of the courts of Malaysia.

21. Relationship with Party Constitution and By-Laws

These Terms govern the use of the website and online services only.
Membership rights, obligations, eligibility, disciplinary procedures, voting rights, delegate status, office-bearing rights, branch or division rights, and all internal Party matters shall be governed by the Party’s constitution, by-laws, rules, regulations and decisions of the relevant authorized Party bodies.
In the event of any inconsistency between these Terms and the Party’s constitution or by-laws in relation to membership rights or internal Party governance, the Party’s constitution and by-laws shall prevail.

22. Amendments to These Terms

The Party may amend these Terms at any time by publishing the updated Terms on the website.
Where appropriate, the Party may notify users of major changes through email, website notice, system notification or other communication channels.
Your continued use of the website after the updated Terms are published shall constitute your acceptance of the revised Terms.
